In consideration for the opportunity to participate in and profit from the Sugar & Spice Children’s Consignment Sale (hereafter referred to as “S&S”), please read and acknowledge your acceptance of the following terms and conditions:
1. Consignor agrees to allow S&S to sell any or all items checked into a S&S sale. The Consignor is responsible for tagging each item and setting the price. If No Discount is printed on your tag(s), your item(s) WILL NOT be discounted during the Half Price Sale.
2. S&S agrees to pay Consignor 70% of the total sales amount for each item sold. Consignor understands that a participation fee, not to exceed $10.00, will be deducted from their profit check. The participation fee may vary depending on the city in which your sale is being held. Consignor agrees that a participation fee will be assessed for every 150 items consigned.
3. Consignor agrees to hold harmless and make no claim against S&S, the lessors of the space where the sale is being held, any volunteer, and/or paid participant of the sale. Further, Consignor agrees to hold harmless and make no claim against the insurer of S&S for any damage, theft or loss of any items consigned. By participating in this sale, Consignor assumes the risks associated therewith.
4. Consignor agrees to waive any and all claims for personal injury resulting from participation in the sale from whatever cause against S&S, the lessors of the space where the sale is being held, any volunteer, and/or paid participant, or the insurer of S&S.
5. Consignor agrees that any item(s) found without a tag during the sale will be placed in Lost and Found. Consignors may look through these items at any time during the sale and/or at Pick-Up to identify and claim their unsold item(s). Any item(s) not claimed during Pick-Up will be donated.
6. Consignor agrees to cash issued profits check within 60 days of the date of the check. Consignor further agrees that if their profits check is misplaced, in order for S&S to re-issue a new check, Consignor will first need to pay the stop payment fee on the misplaced check.
7. Consignor has the ultimate responsibility of making sure their items are either marked for donation OR picked up during scheduled Pick-Up. Consignor agrees that all items tagged for donation will automatically be donated; and all items NOT picked up by the end of the designated Pick-Up, will become the property of S&S and will be donated without further consent.
8. Consignor agrees that they will only consign quality items. Further, S&S reserves the right to reject items which do not meet the required standard of quality. S&S will make the final determination on item acceptability.
9. Consignor agrees that once items have been dropped off at the sale, the Consignor may not retrieve any item(s) until Pick-Up.
10. Consignor agrees that they have visited www.recalls.gov to verify any item(s) they are consigning have NOT been recalled!
11. This agreement will remain in full force and effect for any and all future S&S sales unless cancelled in writing and a copy of same delivered to both parties. If you would like to continue your registration, please click the link below agreeing to the terms of this agreement.
