INFO REGARDING TOYS AND NEW LAWS
We want to do our best to make sure all items brought to our sale are safe. Each Consignor and shopper needs to be aware of recalls, products with high lead levels, safety issues, etc. As a consignment family we can make sure our sale is safe for everyone!

The U.S. CPSC released requirements for new Consumer Product Safety Improvement Act-CPSIA. They also released a statement clarifying requirements for resellers of used children’s products: (in part) "Under the new law, children's products with more than 600 ppm total lead cannot lawfully be sold in the United States on or after February 10, 2009, even if they were manufactured before that date. The total lead limit drops to 300 ppm on August 14, 2009. The new law requires that domestic manufacturers and importers certify that children's products made after February 10 meet all the new safety standards and the lead ban. Sellers of used children's products, such as thrift stores and consignment stores, are not required to certify that those products meet the new lead limits, phthalates standard or new toy standards."
What does this mean for us as consignors?
These are some helpful guidelines given to us from the CPSC:
* CPSC is not focused on resale in regards to enforcement:
CPSC requires everyone to follow the law, there is not an
exemption from the law for our industry and we should all do
the common sense things and take care not to sell un-safe
products. The CPSC is not focused on policing the
resale/consignment industry; they focus on
manufacturers/importers/large retailers (the big guys)
* Specific mention of children's jewelry as products to
totally avoid re-selling.
* Specific guidance on cribs - should be fully assembled,
verified for all parts, not on recall list, safe based on
CPSC guide, etc.
* Specific guidance on children’s toys - bright colored
(red,yellow,blue) plastic toys for children 2-4 are more
common violators of lead limit issues.

CPSC Grants One Year Stay of Testing and Certification Requirements for Certain Products

WASHINGTON, D.C. - The U.S. Consumer Product Safety
Commission voted unanimously (2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans. The stay of enforcement on testing and certification does not address thrift and second hand stores and small retailers because they are not required to test and certify products under the CPSIA.
